Compliance Framework for AI Short Dramas in Mauritius: Entity, Content, Data and Funds
Mauritius offers several natural fits for AI short-drama businesses: no prior approval for content, free remittance of funds, a copyright system under common law, and a data protection framework close to Europe's. To turn these conditions into a stable long-term operating foundation, the key is to run the business fully in line with local rules — a proper entity, compliant content, compliant data and compliant funds. The following sets out the key points on four levels.
1. Entity Compliance and Economic Substance
Support policies for digital-content companies, banking services and copyright protection in Mauritius all presuppose that a company has genuine economic substance. A company that serves only as a registered address with no operating activity cannot benefit from the relevant incentives and is also likely to run into problems with banks and regulators.
- Choice of entity type. Select the appropriate form of entity according to the nature of the business, so as to meet the requirements for tax residence, eligibility for industry support policies, and bank account opening and onboarding due diligence.
- Establishing economic substance. Build a local operating system: a resident compliance director, a fixed commercial office address, archived board resolutions, day-to-day operating records and reasonable local expenditure.
- A properly defined business scope. The scope of business registered with the registrar should expressly include digital content creation, video production, copyright distribution and cross-border digital media services, matching the direction of local industrial policy and avoiding compliance defects caused by operating beyond the registered scope.
2. Content and Copyright Compliance
The country has a well-developed copyright regime and a data protection law modelled on the GDPR. Handled properly, this body of law can become a shield for a content business:
- Build a creative record-keeping system. Keep complete records of original scripts, iteration logs, human editing and revision records, and final-cut review records, so that AI-generated content meets the legally recognised standard of originality and can be defended and published on global platforms.
- Compliant sourcing of materials. Do not use unauthorised film, image or text material for model training or content production, avoiding cross-border copyright disputes at the source.
- Align with global platform rules. Proactively follow the content policies of major international platforms and label deep-synthesis content as AIGC to reduce the risk of throttling or takedown; at the same time, firmly exclude unlawful and non-compliant content and hold the compliance line.
3. Data Protection
Where the business involves technologies such as face synthesis or voice cloning, the requirements of the local data protection law must be strictly applied: obtain the written authorisation of the individuals concerned, keep sensitive data such as original facial images and voiceprints in local storage under strict access control, and avoid the regulatory and civil risks arising from cross-border transfers. It is advisable to retain the relevant authorisations and processing records for the long term for inspection.
4. Funds and Tax
With a properly opened local corporate account, advertising revenue shares from content platforms, copyright sales and subscription income can be remitted in and freely transferred in accordance with the law, making it easier to receive revenue from global operations. On tax, bookkeeping, annual filings and tax returns should be completed as required locally, keeping the company compliant in Mauritius and so able to continue to benefit from any applicable tax arrangements. Avoid prolonged nil filings or irregular operations, which could affect the entity's standing and its eligibility for incentives.
5. Business Boundaries and Risk Control
- Define the business scope clearly, focusing on local content production and on distribution and monetisation for overseas audiences
- Establish standardised due diligence and risk disclosure procedures, keep records and evidence for all business, and ensure risks can be traced
- Keep track of the latest local requirements in the fields of data, copyright and digital content, and adjust internal processes promptly
Once the four lines of entity, content, data and funds are all set up in accordance with local rules, an offshore operating environment can move from being an "option" to a basic condition for the stable long-term running of the business.
